Parents United for Responsible Education, called PURE, says the CPS policy for failing students is unfair and has cost the system $100 million a year for the past 14 years.
PURE plans to file a complaint with the U.S. Department of Education's Office of Civil Rights.
PURE alleges CPS disproportionately holds back Latino and African-American students who don't do well on standardized tests.
There is no comment so far from the public school system.
