Emanuel, Wife To Testify On Petition Challenges

CHICAGO (CBS) -- Rahm Emanuel, his wife, and the tenants who are occupying his Ravenswood neighborhood house will be testifying at a hearing next week on objections to his mayoral petitions.

Emanuel is the subject of dozens of challenges, stemming from questions about whether he fits the residency requirements to run for mayor. Emanuel spent the past two years in Washington as President Obama's chief of staff, and some question whether he is technically a Chicago resident.

Chicago Board of Elections Hearing Officer Joseph Morris ruled that Emanuel's wife, Amy Rule, may be called to testify on Emanuel's whereabouts, but the subpoena might be quashed if it turns out there are no facts on which only she can provide information.

Rob Halpin, Emanuel's tenant, and his wife will also be called to testify on Emanuel's residency.

Morris denied motions from objectors to subpoena several other witnesses, including fellow mayoral candidates Carol Moseley Braun and Gery Chico, and Cook County Assessor Joseph Berrios and Recorder of Deeds Eugene Moore.

He also denied a motion to subpoena FBI Special Agent-in-Charge Robert Grant, despite vehement arguments from some objectors that only Grant would be able to provide an FBI file that ascertains Emanuel's address.

The evidentiary hearing is set to commence at 9 a.m. Tuesday. A status hearing will be held at 9 a.m. Monday.
