The man, Marcin Niepsuj of Hawthorn Woods, later died.

Illinois State Police say Luch struck Niepsuj and pinned him against her car in the center median, as he changed a tire on northbound Route 53 just off the Kirchoff Road exit around 7:33 p.m. Aug. 1.

Authorities say Luch has admitted she was scrolling through her cell phone contact list at the time, the Daily Herald reported.

Niepsuj was pronounced dead at 2:38 p.m. Sept. 1 at Advocate Lutheran General Hospital in Park Ridge, and now, the Cook County State's Attorney's office says charges could be upgraded, the Daily Herald reports.

Luch already has been ticketed for improper lane usage, improper passing on the shoulder, and using an electronic device while driving, the Daily Herald reported.

Neipsuj's family has also filed a personal injury lawsuit against Luch, which is due for a hearing in October, the newspaper reported.
