CRYSTAL LAKE, Ill. (CBS) — A Crystal Lake waitress says she lost her job because she wore a Tea Party bracelet to work.

As WBBM Newsradio’s Bob Conway reports, Megan Geller, 23, tells the Northwest Herald she wears the bracelet with the words “Don’t Tread on Me,” the phrase that appears beneath the iconic snake on the yellow Gadsden flag, and which is often seen and heard at Tea Party rallies.

Geller tells the newspaper a couple she was serving at the local Outback Steakhouse took offense and complained.

Geller said her mother, Tonya Franklin, got the bracelet at a Tea Party event, and a couple dining at the restaurant did not like it and asked for the manager, the Northwest Herald reported.

After Geller was fired, a group rallied in front of the Outback Steakhouse, waving American and Gadsden flags and accusing the restaurant of violating her free speech rights, the Northwest Herald reported.

Company officials tell a different story. They say Geller was inattentive to diners at two tables and say that if the bracelet had been a problem, managers would have told her to remove it, the newspaper reported.

We’re not talking about a t-shirt or waving a flag. We’re talking about a small bracelet, probably one of those rubber ones that you see people wearing all the time, showing support for this cause or that one. These people just sound like the mean type who would pick at the smallest detail. Were they really that offended by a little braclet? I am not a Tea bagger or a Republican, but one thing I definately am not is a Democrat. Either one of the other choices are better than the latter.

@ StupidPeople George W. could represent a number of people or even some four legged animals and so on, but the first one that comes to my mind is George Washington (George W.) and if I may further your education just a bit. George W. was an Indepent. Now you rush to judgement on this person by accusing he or she of lying. With your limited education and minimal understanding of political parties I am very pleased to see how far you’ve come. It’s just a shame that perhaps most of your travel has been in the wrong direction, but we can work on that.

Glad I got a rise out of so many. Yes you are right, when you work someone you should be politically neutral in the workplace. THE POINT is politically neutral is “we are equal but some are more equal than others” I am not a Dem,a Repub or a member of Tea Party.I just find interesting that if you views are left wing it’s over looked most of time and if it is brought up it’s a freedom of speech issue. Free speech rights? I wasn’t aware that Outback Steakhouse is now considered a government entity.

The simple fact is, no government action means no free speech rights. As employees we should all be aware that most of us can be fired for a good reason, a bad reason, or no reason at all, so long as it is not an illegal reason (such as discrimination on the basis of race, sex, religion, age or disability).

You can absolutely be fired for political views. I work for a company that caters to liberal, progressive, Democrat interests, and we’ve been told in no uncertain terms that they don’t care what our political views are, but if we ever publicly make them known, and if they happen to be contrary to our customer base, we will be terminated. That includes making monetary contributions to Republicans/conservatives, since that information becomes public available.

They were within their rights to fire the young lady for wearing the bracelet, but I am within my rights to add Outback with Olive Garden and Red Lobster to my list of unpatriotic and anti-free speech places where I will not spend my money.
If Outback truly fires employees for being “inattentive to diners”, they wouldn’t have many employees on their payroll.
This firing was clearly politically motivated so I will have to begin complaining to store and restaurant managers whenever a Subaru with Obama stickers offends me in a parking lot.

@John…FEDERAL law does not protect political affiliation in descrimination cases. However, WITHIN the government, it is illegal to descriminate with respect to political affiliation by executive order. I’m not sure about Illinois statutory law, but unless there is a local law against political descrimination, you can be fired for that reason. Don’t agree with it…but to the best of my knowledge…that’s how the law works in these cases.

An employer can fire you for just about any reason they want so long as it is not illegal.

They can’t fire you for being an advocate for Tea Party principles in your private life but if you’re advocating them at work they most certainly can.

This is what is said in the first amendment: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

So, considering thats whats actually written, how exactly were her first amendment rights violated? Clearly they werent. So, does this mean you want there to be government regulation of private businesses? Cause thats what it sounds like you want.

Actually Heather has it exactly right. The rights in the constitution are designed to protect individual liberties from governement opression, and that’s as far as they go. A private business (non government owned) isn’t bound to let their employees say whatever they want to.

Now from a HR standpoint, if the girl were any good at her job, she probably wouldn’t have been canned. It takes some time and effort to interview and hire candidates, as well as train them and then ramp them up to where they’re operating at full efficiency. Given the option of correcting a small deficiency in a good employee (i.e. telling them to take a bracelet off) or going through the firing/ hiring process which puts the restaurant at a disadvantate in terms of resources, it’s a no brainer.

Read the Constitution good sir. Free Speech is a right the government can not infringe upon. A business can tell you not to say certain things. Freedom is a two edged sword in some respects. You’re are free to do what you want as long as you don’t violate someone’s rights. A business can do the same. If you agree to the business’ terms for employment, you are obliged to follow it. If you don’t like it, you are more than free to find a job elsewhere.

Really? The inability to distinguish between fact and opinion astounds me.

The Constitution states that “Congress shall make no law… abridging the freedom of speech.” By it’s terms the free speech right in the Constitution is only implicated by action of the federal government. The Supreme Court has interpreted the right of free speech to be implicated by state action pursuant to the due process clause of the Fourteenth Amendment, which states “nor shall any state deprive any person of life, liberty, or property, without due process of law.” According to the Court, freedom of speech is so essential that citizens are deprived of due process when state government abridges the right.

Now that we know what the Constitution IS, the Constitution is NOT a list of things other people and/or businesses are not allowed to do to you. A private business does not violate any Constitutionally protected right when it abridges the freedom of speech. That’s just simple fact- first year law school case law. I really don’t know how we jump from learning how the Constitution works to the insinuation that I ought not be allowed to vote, but given the level of education you’ve displayed, I won’t sweat it too much:)

Illegal? No. The First Amendment limits what the government can do about our free speech. So unless the government told Outback Steakhouse to fire her, she (and you, vicariously) are out of luck.

JWS is absolutely right. I am a libertarian as well. I was simply explaining the law on this issue. It is not a free speech case because the Constitution only protects free speech from encroachment by the government. Since Outback is not a government entity, it can constitutionally limit the speech of employees. And I “conveniently” left political affiliation and views off the list of illegal reasons for terminating an employee because political affiliation and views are not protected under federal law or most state law.

We must be able to dispassionately discover the actual state of what the law is, because only then can we decide based on our own values whether we agree or disagree with that law, and then lobby for whatever changes we deem appropriate. In your case, Mr. Hamilton, your time may be well spent lobbying your representatives (both federal and state) to protect political affiliation and views in employment.

She could be fired for her political views, and Outback has the right to do so, since they are a private enterprise. Now, Ms. Geller is entitle to express her opinion in public, and outraged patrons can decided not to support that restaurant anymore, all with in their own rights. I for example, will not support that Outback restaurant, or perhaps any of them, since I am or was a very good customer of them with my friends.

There is a difference between freedom of speech and freedom of expression, number one. The former is protected, the other may or may not, and it’s the acts of liberal “activist judges” that have included expression as a part of the 1st Amendment under the principle of judicial review, which of course, Teabaggers shoud eschew… So I find it hilariously hypocritical for a Teabagger to be for freedom of expression when in fact, it’s a liberal value.

Secondly, you do NOT have either freedom in a workplace environment. Unless otherwise stipulated in the law, your employer can fire you for dress (or lack thereof), statements that are uttered to anyone on the premises, or anything that is written on the Internet as long as one is using an employer’s computer. And there is no recourse for wrongful termination in this case. You have NO reasonable expectation of privacy in your work. Period.

Case in point, are the dress codes in workplaces that forbid navel-low pants and piercings. Or dreads. Or visible tattoos. It’s legal. Subject to the sole interpretation of the employer. But you don’t see Teabaggers complaining about people with rap clothes or dreads being fired. Of course.

Thirdly, if I was served by a waitress sporting a Teabagger wrist band, I’d complain to the manager. Besides considering her demented for supporting those who are bent on subjugating her.

We should be fired for ANY reason, including race, sex, religion or anything else. No one has a ‘right’ to a job and it is the entrepreneur that takes the risks–many times failing and losing their life savings.
Lest you think me heartless, keep in mind that an efficient owner will hire the BEST person for their company usually despite any other considerations. If they’re omitting someone for silly reasons (age, race, etc) they’re at a distinct market disadvantage and will not be solvent for long.

Sounds great if you’re rich and well-connected. But the gap between rich and poor is greater than it’s ever been. Nearly 1 in 5 Americans are unemployed or underemployed. Millions of Americans have been abandoned and have no way out. Capitalism does not work. We should have a maximum wage that is 10 times the minimum wage, and corporations should be outlawed for anything but luxury/entertainment type items. Essentials like food, housing, transportation, energy, healthcare, schools, etc., should all be run as not-for-profit enterprises under the purview of the federal government.

You wouldn’t know real capitalism, since it hasn’t been practiced since 1908. Real capitalism has a small government that tends to only the things given in the Constitution. National defense, postal roads, and arguments between the states. That’s it.
Real capitalism allows people to FAIL for making mistakes. Tell me when you saw the last real failure of a major company? They all simply go into chapter 11 or 13, shed their debt or get a bailout from the government. THAT is NOT capitalism.

There are no real hindrances for starting a business in real capitalism. If you want to be a barber, then you open a shop. If you are good people come to you, if you suck you are out of business. No license fees, no rules and regs, no schooling. You succeed or fail on your own. If you wanted to learn a trade then you interned and learned it.

There were no income taxes, no corporate taxes and no FICA or SSDI taxes. The only way government got any money was on tariffs and sales stamps. If you have a “maximum wage”, then you will have ZERO businesses, because the person starting the business is taking all of the risk, and deserves the rewards. Not everyone is worth 1/10th of the CEO. They show up and go home on a time schedule. The CEO is responsible 24/7/365 for everyone working for him.

I also noticed that you failed to go after anyone in entertainment for their earnings. Or congress or the President for their earnings.

Finally, if you want to live where all of your “essentials” are not for profit, then I suggest you move to Cuba or some other Communist country(because that is what communist means, everyone is the same, no matter the skill level) The USSR tried that one. They failed in less than 80 years. The US has been going for over 200. France and Germany for over 500. England for over 1000.

Throughout history there have been two basic forms of social organization: collectivism and individualism. Under socialism a ruling class of intellectuals, bureaucrats and social planners decide what people want or what is good for society and then use the coercive power of the State to regulate, tax, and redistribute the wealth of those who work for a living. In other words, socialism is a form of legalized theft.

What you are seeing in Greece and other Europe countries and with socialism it has run out of people to steal from.

Yes, there are winners and losers in capitalism. The winners are those who are honest, industrious, thoughtful, prudent, frugal, responsible, disciplined, and efficient. The losers are those who are shiftless, lazy, imprudent, extravagant, negligent, impractical, and inefficient.

What the issue is today is the government in an effort to get or stay elected try to select the winners and losers to gain votes. Those without jobs are there because Obama wants a collective form of government and to get to that he needs millions of Americans coming to the government with their hands out for what few benefits the government can provide. Remember in collectives losers are discarded in a trash heap and imprisoned or you can find them in mass graves.

As a former manager of retail stores, I can tell you for a certainty that nothing with words on it would have been allowed. Customers come in for the service and goods available, not to look at what that person is wearing. We were even so “evil” as to disallow any extra earrings. One pair only and only for women. This was a fortune 500 company when I was there. I was never allowed to wear even a necklace that could be seen at any of the stores or restaurants that I worked at.

But private colleges do not have to tolerate the Ward Churchill’s of the world whereas public universities are obligated to uphold first Amendment free speech.

Though Outback serves the public and may not discriminate with employment or patrons as it relates to Blacks, they most certainly have the power to bar political speech by employees.

Thankfully we have a nice variety of family owned restaurants to choose from, these big corporation restaurants rarely see me inside their doors.

The best economic days were in the 1950′s? Really? The average house was was about 1200 square feet, now it is over 2200 square feet. The average home had one car, now it is two at a minimum. The average house had a SHARED phone line, called a party line. Now the average person has their own cell phone. The average car got 8MPG, not 24MPG like now.

Secondly, and far more importantly, study history please. We had 90% tax rates in 1917 by 1920 we were in a heavy depression, deeper than the Great Depression, but not as long. Why? Tax cuts spurred growth and that started the roaring 20′s.

Study the Great Depression, they had 90% tax rates then as well. How many people actually PAID them? Very few, those that had money simply QUIT working and shut down their businesses. If that is what you want, then by all means raise the tax rates. If what you really want is increased growth, then you should be begging for the lowest possible tax rates.

It seems to me she has some legal options against the steakhouse. When I was manager if I was to fire every cashier that a customer complained because of a personal issue like an employee was black and didn’t say sir to a white customer, yes that has happened etc I would be firing people every day. BTW I being in restaurant where liberals customers are at a table and are partying and making fun at conservatives and nothing happen. Next time, I guess I will try complaining and see what happens.

Real believers in true free market capitalism, such as I am, would actually support the restaurant in firing her for wearing the bracelet, if they have a policy against it and she refuses to follow it. People need to learn to understand that just because you have rights, does not mean you can do anything you want on other people’s property when they are paying you for your time.

If the government were persecuting her, this would be a free speech issue. If the employer fired her, it could be because of her bracelet and I would say that is their right. And anyone who believes in the meaning of that bracelet should agree with that sentiment, and if they don’t, they do not understand the true meaning of economic freedom.

Believe me, James, anyone who is a conservative also understands that the business had a legal right to fire her if they didn’t want her working for them. I think a lot of the comments here blur the line between this legal right, and whether or not it was right or wrong. Or, not only was it the morally just thing to do, but indignant of the reality that if this had happened to a leftist (Say, for example, a busboy is fired for wearing his Che t-shirt or having an Obama bumper sticker) most the media in our culture, dozens and dozens of news networks, comedy and morning shows, etc. would be condemning it as heartless and mean spirited and ugly and representative of the cold heart and caricature that the Left has worked so hard to clarify and build of the right in the cultural ether. This hypocrisy makes it hard not to fight fire with fire when it happens in the opposite. But of course, you are right about Outback having the right; and thank you for explaining clearly why.

Below is a copy of a note that was sent to Outback. We are so quick to condem things that bother us (as did the Outback customer) without knowing we are condeming.
“I have just read a newspaper article concerning the firing of a waitress, Megan Geller at your Crystal Lake, Ill. location. The article stated that Ms Geller was fired for wearing a bracelet that was inscribed with “don’t tread on me”. Are you aware of the historical significance of this statement. It goes back to the struggle of our forefathers in 1775 and is still used by the US Navy today. If she was in fact fired (solely or partially) for wearing this bracelet. Outback owes her and all of us an apology.
I would like to see Outback follow through on this in the media. My wife and I visit our Outback in Saint Lucie West, FL at least 3 times a month.”

Let that right not be confused with certain standards which employers have their own right to limit what its employees say or do, to reduce disruption to customers. This isn’t a left or right issue. It’s about employers making certain general rules or guidelines on a server’s professional appearance. Don’t like it? So what the manager stated – she was fired for ‘being unattentive” to two tables…. I understand it is an at-will employment state, however, they gave us ‘the official’ reason. How many times have all of you been at restuarants and the only time you see the server is taking the order, picking up the check (the food was brought out by someone else). When you returned to that restuarant did you see that server still there? In many cases yes. They did not mention any patterns of behavior. So my question to you, should a server be fired for having 2 complaints?

A company has a right to monitor what their employees wear; political statements are normally considered taboo at most restaurants. When I was a teenager working at Outback I signed a paper to not wear anything that would possibly be offensive (i.e., religious, political, pro-choice/pro-life….).

It makes good business since. For example, I avoid church run coffee shops because of the religious idiots and I avoid the hipster run coffee because of neo-hippies. I like to get my coffee at places that just serve coffee not a message..

That’s the company line. were the two diners who claim she was inattentive the same ones who were offended with the bracelet? If it was truly bad service and she had no bad track record, they would not fire her for that. She’d get warnings first. So had this waitress had a track record of previous incidents of poor service? I don’t know all the facts, but this whole thing smells a bit if you ask me.

This is an example of how our culture is now responding to being “offended”. Heaven forbid someone who waits on you in a restaurant have different political opinions. If you feel ‘uncomfortable’, you complain to the manager rather than stopping to consider first that the other person is not harming you in any way. It was the first flag ever carried into battle by the United States Marine Corps, during the American Revolution. It also was known as one of the US flags before being replaced by the Stars and Stripes. In addition, since the first Patriot Day on September 11, 2002, which remembers lives lost in the September 11 attacks the First Navy Jack has been flown on all active naval ships for the duration of the global war on terror which contains “DONT TREAD ON ME.” These words appear on all US Drill Sergeant identification badges. For those that are offended please do everyone a favor get a life or leave on the next plane or ship to China you will love it there.

What ever the REASON the restaurant claims they had for firing her, SHE HAS THE STRONGER CASE that the reason is her bracelet simply because of the TIMING of the firing. It came on the heels of the customers who take offense at a flag that’s been in existence for several hundred years.

Outback’s in trouble, and rightfully so. They will have to show a record of reprimands on her performance, and that this is simply the straw that broke their back. Additionally, they have to show they made an effort to train her better if they felt she was lousy.

Did the restaurant follow a proper protocol as far as any type of disciplinary action? Sad thing about this is it will be presumed that all Outbacks will be this way. The ones I dine at are of a conservative nature and if these two offended ones complained the manager would have told her to take it off this one time not showed her the door. Also this story appears to be incomplete or missing something.

No bracelets, no rings (other than wedding), no necklaces, modest makeup, etc. They can control abosolutely everything you say and do while in their store. No offense to anyone on the list of comments, and if i missed the one where it actually explains the “meaning” of that flag then disregard.. I have no political affiliation – I agree with those that make their point about the “offense” culture we now have, except for when it comes to the founding religion of this country, Christianity. Its ok to trounce those people now or any affiliation with that line of thought including the Tea Party. With that said, That FLAG was flown by one of the first Marine Corps Units ever, during the Revolutionary War.. We flew that flag due to being walked on by the King of England at the time.. It is not a Tea Party thing, it is an American Thing.. You who don’t see it, the enire gov’t, not just Democrats or Republicans ,but all are slowly but surely making you dependent on them.. They will continue to strategically place and orchestrate events to assert additional authority. The employee was not let go because of her Tea Party bracelet. On the night in question two separate tables complained about her lack of attention – one flagging down the manager to pay their bill as they could not find her and another going to the bar because they received the wrong drink and could not find her.

When the manager spoke to the employee about this she responded by yelling at him with a hostile attitude. This is why she was fired.

She was not fired because a customer complained about her bracelet. That would have simply been handled by asking her to take off the bracelet.

As to the Illinois Department of Employment Security letter stating she was fired for wearing the bracelet – this simply reflects what the employee told them. No hearing was held that we participated in, nor did we submit any information regarding her claim.

I would also point out this bracelet is not a Marine Corps bracelet nor is it a bracelet supporting our troops. The bracelet has only the motto “Don’t Tread on Me” followed by “November 6, 2012”. November 6, 2012 is the next Presidential election. The bracelet does not have any Marine Corps insignia. When the customer asked the employee about the bracelet, she said it was a Tea Party bracelet.

Sorry, but the constitution only applies to the government, it doesn’t guarantee that a private person in a private business can say or do what they want with impunity. As reprehensible as it may sound, if a business wants to fire a waitress for wearing this bracelet, or refuse service to somebody wearing a jersey for the opposing sports team, or a military uniform, they’re free to do it. It isn’t the greatest business decision, but as long as they don’t discriminate based on the reasons outlined in Title VII, they’re not discriminating illegally.

Did you actually just say that the constitution only applies to the government and NOT the people? It absolutely DOES guarantee private individuals the freedom to say whatever they want whenever they want!! That’s what the constitution IS! A gurarantee that you have certain unalienable rights endowed by our creator that NO government can take away. If a business wants to fire someone for wearing what they deem inappropriate, that is THEIR RIGHT to do so as a participant in a free market society. The only thing that sounds reprehensible is the first sentence of your comment. I sure hope you’re nto teaching your children that.

It is sad that someone got fired for wearign a Tea Party bracelet. It’s ever sadder that the manager lied and said it was because she was inattantive to 2 (just 2?) other diners as that’s not really a good excuse to fire someone especially if you’re busy. But the saddest thing is, and I am a Tea Party supporter, that people are forgetting that in a free market society, a manager or owner can fire anyone they want for an reason they want. Except, of course, for their religion, race, creed, sexual origin, etc.. Companies have the right to fire anyone for anything that they may wear to work or for saying something bad to the customer or not doing their job correctly, it’s the company’s right to do this. If they don’t like the TP, they can fire someone that supports them. It’s their company. Not yours, not mine, not the government’s, it’s theirs. Just like if you had a company and one of your workers did something you didn’t like or you just didn’t get along, you have the right to terminate them without reason or warning.

We need to roll back the calendar on our views if we don’t want to be killing each other in the streets. Whites verses Blacks and etc….Democrat verses Republican. We’ll be fighting this one in the streets just and America will slip into extinction. Our enemies will wait till we are finished and come in for the rest. If it is Russia they don’t like Blacks anyway and for that fact Whites that used to be free. If it’s the Chinese pretty much all of us are toast. There are two issues here.

First, if she violated their policy, it was a minor violation, and she should have been reminded to remove the bracelet. She may simply have forgotten. Firing her is an extreme action for something so trivial.

Second, the leftists are tremendously intolerant, and may well become violent as we undo all of their failed liberal big governemnt. The “occupy –” nuts may be just the beginning.

Apparently CBS Chicago limits the number of conservative viewpoints on their website. No other reason for none of my posts to not be displayed as I neither cuss or disparage others. I do attack liberal view points by pointing out their flaws.

On this issue, I hope this young lady gets some help and take it to her employer. If not her then hopefully the once patrons of this restaurant will hold them accountable.

I have personally witnessed liberals defame people for no other reason than they have a conservative bumper sticker or even a Purple Heart Plate displayed on their vehicle. I have been a victim of bloggers that report my posts as being abusive for no other reason than they can’t legitimately debate their positions. I have no doubt that her wearing a Tea Party bracelet and exaggerated or just plane ole made up complaints were a major factor in the restaurant taking action against her.
