Amid Title Run, Wade Again Caught In Custody Battle With Ex-Wife

CHICAGO (CBS) -- An unwanted domestic distraction for Dwyane Wade as he prepares for Game 4 of the NBA Finals tonight: Wade's ex-wife, Siohvaughn Funches-Wade, was arrested over the weekend after an incident delayed their sons' return to Miami for Father's Day.

On Tuesday, Wade's attorney, James Pritikin, asked a judge to suspend Funches-Wade visitation rights.

Funches-Wade was charged with two counts of attempted child abduction, two counts of unlawful visitation interference and one count of resisting arrest, all misdemeanors.

"This is the second time she has tried to frustrate visitation with his children on Father's Day," Pritikin told CBS 2's Brad Edwards.

Funches-Wade posted $10,000 bond on Monday, according to Cook County Sheriff's spokesman Frank Bilecki. She is due back in court in August.

According to Wade's court filing, his sister was supposed to pick up his two boys from Funches-Wade around noon Saturday so they could make a 3:05 p.m. flight from Chicago to Miami, so they could be in South Florida for the entirety of Father's Day.

Wade's sister got no response at the home, and after "several hours" the sheriff's office was called to send someone to the scene, according to the filing.

It also said Funches-Wade attempted to leave the home without the children when one of the responding deputies tried taking her into custody. The boys, at that time were inside the home, according to the filing.

Wade eventually hired a private jet to bring his sons home early Sunday.

Funches-Wade claimed she was never asked to hand the children over to Wade's sister.

"I was never once asked to turn over the children," she said in a phone interview.

She insisted she's done nothing wrong.

"I haven't done anything, except for what I know is best for my children. I've fought and I've protected them as best I can," she said. "I don't have the fame he has, I don't have access to the millions of dollars that he has, so I'm not able to do some of the things he's been able to do."

Funches-Wade said her focus now is making sure her children are okay.

"They saw what was happening, and they were hysterical and crying uncontrollably," she said. "It's been several days, and I can't tell you whether my children are alright or not."

She said she fears the ongoing custody dispute will harm their children.

"They're saying the charges are against me. I know who is this ultimately is going to destroy, and it's those two little boys – so even if I fight for my freedom, I'm fighting for Zion and Zaire, once again, by myself, and it's sad that I'm not doing it with their father. That's sad," she said.

Records show Funches-Wade was transferred to a hospital after the incident on Saturday. She told officers she was experiencing shortness of breath and thought she was having an asthma attack.
