Report: Investigators Have Met With Patrick Kane Amid Rape Investigation

(CBS) Blackhawks winger Patrick Kane has had a meeting with investigators as a rape investigation against him in Hamburg, N.Y., moves forward, the Buffalo News reported Monday afternoon.

The meeting came in the presence of Kane's attorney, Paul Cambria, and included officials from the Erie County District Attorney's office and the the Hamburg Police Department, according to the Buffalo News. The case is a joint investigation between those two organizations.

A woman has accused Kane of raping her in the early morning hours of Aug. 2 after she and a friend returned to his house in Hamburg after they met at Skybar in Buffalo earlier in the night. The two accompanied Kane to his house in a vehicle driven by Buffalo Police Lt. Thomas English, according to the News. English has long served as Kane's driver. He was off-duty at the time.

The woman went to the hospital and had a rape kit administered after the alleged sexual assault.

Kane hasn't been charged with any crime as the investigation continues.

CBS 2 Legal Analyst Irv Miller says there are several ways to read the meeting. He said it's uncommon but is likely part of a strategy on Kane's part to convince prosecutors not to file charges – or to file a misdemeanor instead of a felony.

"The defendant is getting a golden opportunity to tell the prosecutor his side of the story without any downside because the agreement is, up front, anything I tell you, you can't use against me, so it's a win-win situation," Miller says.

Coming off a championship, the Blackhawks open training camp on Sept. 18 at Notre Dame. Kane's status with the Blackhawks remains unchanged as of now.
