Case Against Jack McCullough Dismissed By Judge

(CBS) -- A judge has dismissed the case against a 76-year-old man who a prosecutor says was wrongly convicted in the 1957 killing of a 7-year-old Illinois girl.

DeKalb County Circuit Court Associate Judge William Brady accepted a motion Friday to dismiss the case and avert a retrial.

Jack McCullough was sentenced to life in prison in 2012 in the killing of Maria Ridulph in Sycamore.

But the successor to the state's attorney who prosecuted the case says a review found flaws in the investigation and prosecution.

He determined McCullough's alibi was solid.

Brady had vacated the conviction and ordered McCullough released April 15. On Friday, he dismissed the case outright.
