LAPD Has Opened Criminal Rape Investigation Of Derrick Rose

(CBS) The Los Angeles Police Department has an open criminal rape investigation of Knicks point guard Derrick Rose, CBS News has confirmed.

This news come as a $21.5-million civil lawsuit in which a woman accuses Rose and two of his friends of gang raping her in August 2013 has continued to move forward. That case is set to go to trial on Oct. 4. Rose wouldn't be required to attend the civil trial, though it's expected he'd be present for parts of it, The Associated Press reported.

The accuser contends she didn't give consent while she was incapacitated after a night of drinking. Rose's lawyers contend she did give consent.

The LAPD will keep the accuser's identity anonymous in the criminal investigation, a detective confirmed to the accuser's lawyers in a memo obtained by the whitebronco.com. A federal judge recently ruled that the accuser can't remain anonymous in the civil trial.

The accuser's lawyers have indicated she's ready to proceed to trial, according to reports.

Late last week before this news of the criminal case broke, president of basketball operations Phil Jackson said the Knicks are "not concerned" about Rose's civil trial and indicated Rose has the same thought process.

"We're just going to let the process work itself out," Jackson told reporters.

"We're not concerned. We understand this is a serious subject we're talking about, but this has to be done outside of our control. It's something we can't control. So Derrick has expressed that he's not concerned about it. I mean he's quite aware of it, but it's not keeping him up at night, so we'll leave it at that."

A Chicago native, Rose played his first eight seasons for the Bulls and won the 2011 league MVP.
