Dwyane Wade's Ex-Wife On Custody Battle: 'I Will Not Give Up'

CHICAGO (CBS) – She's in a nasty fight for her kids with her former husband: Chicago native and NBA star Dwyane Wade.

CBS 2's Suzanne Le Mignot talks with Siohvaughn Funches-Wade about her life after divorce.

"I'm doing as best as I can. I haven't seen my boys since August," she says.

Funches-Wade is the mother of 10-year-old Zaire and 5-year-old Zion. She and Dwyane Wade have been involved in a custody battle since their 2010 divorce.

The Miami Heat guard has custody.

"I love them very, very much and I am doing everything, everything I possibly can," Funches-Wade says. "I'm using every dime that i have and fighting in every way I know how to fight. I will not give up."

After her recent arrest for allegedly not turning over her children on time after a visit, a judge restricted her visitation. Funches-Wade says her first scheduled visit didn't even happen.

She says her second visit was cut short because a judge allowed wade to take the kids to the London Olympics.

"Their job is not to facilitate an image -- it's to be loved by their dad," she says. "I am being their voice when they can't speak for themselves, and I'm going to continue to do that."

Funches-Wade is now going to law school and wants to use her degree to help others.  All of the charges against her except one have been dropped.

Dwayne Wade's attorney had no comment about this story.
