Peterson Lawyer Moves To Halt Motion By Other Attorney

CHICAGO (CBS) -- Drew Peterson's lead lawyer has filed a motion to strike down what he calls an unauthorized motion by another attorney.

Joel Brodsky also is asking for a criminal contempt of court citation against Naperville lawyer John Paul Carroll and for a special prosecutor to investigate what Brodsky says are leaks of impounded documents.

Brodsky wants Carroll thrown in jail on criminal contempt and fined.

Earlier this week, Carroll filed a motion for a new murder trial for Peterson on the grounds that Peterson's defense team, led by Brodsky, botched the case.

Brodsky said that motion "has no basis in fact whatsoever."

Brodsky insists Peterson never authorized Carroll to take that action.

He did say Carroll spoke to Peterson about legal issues regarding Peterson's pension.

Will County Judge Edward Burmila will hold a hearing on the matter tomorrow.

Peterson was convicted of killing his third wife, Kathleen Savio in 2004.
