CHICAGO (CBS) — Union Pacific and Metra are facing a lawsuit after a crash in Wheaton left a woman critically hurt.

Last month Maria Maestas was crossing the tracks when a heavy piece of equipment slammed into her car, dragging it 150 feet.

The lawsuit says workers were in the area, and the crossing gate malfunctioned. It goes on to say Union Pacific should have had workers at the crossing in case the gates fail.

Union Pacific has not responded, and Metra says they do not have a comment.
