Convicted sex offender Scott Eby had been found fit to stand trial for the murder of 3-year-old Riley Fox, who was sexually assaulted and drowned in a creek in Wilmington.

Now Eby's attorney Michael Renzi is indicating that Eby could plead guilty at a court appearance on Wednesday.

Renzi says talks are going on with the Will County State's Attorney's office, "We are in negotiations. I'm confidant about the negotiations. However, it is Mr. Eby's decision."

Renzi would not confirm reports that Eby would plead guilty to the Riley Fox murder in exchange for life in prison - avoiding the death penalty.

Eby was charged earlier this year because prosecutors say there was a DNA match.

Riley Fox's father Kevin was cleared by DNA. Prosecutors had said he incriminated himself, a confession which a civil jury found was coerced.
