Teen Held On $1 Million Bond In Fatal Wreck

JOLIET (WBBM) — A Will County judge has set bail at $1 million for a teenager accused of driving drunk, losing control of his SUV and killing a woman who was asleep in her Bolingbrook apartment early Saturday.

Those in the courtroom for the bond hearing say when 17-year-old Luis Benito heard the case against him, he threw his arms up and cried.

Benito is accused of driving with a blood alcohol level of .204 – more than two-and-a-half times the legal limit.

He is charged in the death of 48-year-old Josefina Prospero, who authorities say was killed as she slept – when Benito’s vehicle crashed through her apartment.

Prospero’s boyfriend was injured.

The Will County state’s attorney says Benito is charged with four counts of aggravated DUI.

Prosecutors say Benito had been doing doughnuts in the parking lot of a Bolingbrook restaurant and bar before the crash – and that the bouncer said he had to jump to get out of the way after Benito drove toward him.

Authorities say Benito is in the country illegally and was driving without a valid license.

If convicted of the DUI charges, Benito faces up to 14 years in prison.

If this dummy is here illegally and has no license then the person who gave him the car should be arreseted also.

Really sad for all involved. Blackout drunk is not conscious decision making. A sad loss of innocent life, and sorry for this kid’s mistake.

  • Secondtim

I agree with Dawgman, and why dosen’t the death penalty apply? This woman was in her own bed! He had to invade her house to kill her!!!

  • Matt

Secondtim… You numbskull, he didn’t kill someone on purpose, that is why the death penalty does not apply. I hate people who speak just to speak. Just because you are dumb doesn’t mean you have to let everyone know…

When was the last time the death penalty applied in any DUI case?

  • D

Why didn’t the bouncer call the police on this idiot, this could have been prevented, not a big deal to call on someone who is drunk, or driving erratically, or was this idiot served at that bar where he was doing donuts in the parking lot???

  • Roberta Waker

The death penalty SHOULD apply in cases of DUI because EVERY driver should know by now that if you drive drunk, you are capable of killing or maiming someone. Stupidity is no excuse to get off on murder by DUI. If he’s illegal, he should be deported. I agree that whoever sold him a car without a valid driver’s license should be prosecuted. ILLEGALS are killing this country and he’s only one of many. Let’s hope the new GOP-run Congress has the balls to do something about ILLEGAL immigration..

  • Jrena Davis

My condolences to the family who is no doubt sufferig at this time. The bouncer should have called police also.
