Next Step For Rahm Emanuel In Ballot Fight

CHICAGO (WBBM) -- What happens next?

WBBM's Steve Miller talked with an attorney who specializes in election law but does not work for a candidate in the mayoral election.

The case will now be appealed by Emanuel's attorneys to the Illinois Supreme Court, where the justices are likely to accept the case, according to Chicago attorney Michael Dorf. Emanuel's attorneys will file that appeal on Tuesday; they filed for a stay of the appeals court decision on Monday afternoon.

"These Supreme Court justices are elected," he said. "They're not appointed. They do take politics into consideration."

Among the seven justices on the state Supreme Court: Justice Anne Burke, the wife of Ed Burke, the powerful alderman of the 14th Ward.

"Alderman Burke is very much in support of Gery Chico," said Dorf. "I would be amazed if that played a role. I think Justice Burke is not going to be swayed by that but certainly, that's what she hears at home."

Could Rahm Emanuel stage a write-in campaign if he's not allowed on the ballot?

Dorf says he could, but probably still couldn't be mayor if the courts have ruled against him on residency.
