Naked Naperville Man In Car Sentenced On Drug Charge
NAPERVILLE, Ill. (STMW) -- A 28-year-old man who was found naked in the back seat of a car with his girlfriend earlier this year in west suburban Naperville has been placed on supervision and fined in that matter.
As happened in the case of his girlfriend, Daniel R. Lavigne pleaded guilty to a municipal charge of unlawful possession of drug paraphernalia, the Naperville Sun reports. A companion count of possession of less than 30 grams of marijuana was dismissed in exchange for that plea, according to DuPage County Circuit Court records.
Associate Judge Mary E. O'Connor on Thursday accepted Lavigne's plea. Court records showed O'Connor placed him on an unspecified period of non-reporting court supervision and assessed $720 in fines and court costs.
O'Connor also presided June 30 in the sentencing of Lavigne's girlfriend, Callea L. Plunkett, 22. She, too, was found guilty of possessing drug paraphernalia, and was ordered to pay $630 in fines and legal fees as her penalty.
Lavigne and Plunkett were arrested about 11:47 p.m. May 27 after Naperville police found them in a vehicle parked on the 100 block of Douglas Avenue, just north of the city's downtown area and outside the apartment where Plunkett lives.
Police had been sent to the apartment complex to investigate a report of a "suspicious vehicle" in the lot, Sgt. Bill Davis said in May. Davis said a police report stated Plunkett and Lavigne "were found in the back seat area with no clothes on when officers approached" the car.
A police canine unit arrived in the area shortly after the couple had gotten dressed. Davis said the specially-trained dog detected the presence of drugs inside the car, and a subsequent search turned up a small, plastic bag containing 0.4 grams of marijuana, along with a glass smoking pipe.
Lavigne is on probation in a 2008 felony case of marijuana possession in Bolingbrook. Plunkett has been convicted twice in two years of driving under the influence, in 2011 in Downers Grove and last year in Aurora.
The judge who presided in the Bolingbrook case sentenced Lavigne to six months in jail and placed him on 2 1/2 years of probation. Plunkett was placed on court supervision for the Downers Grove DUI, and was ordered to perform community service work following the Aurora DUI conviction.
