1. HOW TO ENTER
a. These rules govern the Pepsi Tailgate Throwdown promotion (the “Promotion”) being conducted by WBBM(AM) and WCFS-FM (collectively, the “Stations”) beginning at 5:00 p.m. Central Time (“CT”) on Friday, August 24, 2012 and ending on Sunday, December 30, 2012 at 12:00 (noon) CT (the “Promotion Dates”).
b. To participate in the Promotion, you may log onto http://www.cbschicago.com/contests or http://www.tailgatethrowdown.com and follow the instructions to enter the Promotion. Submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth, a valid email address and your original recipe submission in the online entry form. Completely type your original recipe, listing each recipe ingredient (including garnishes) with specific flavor, exact measurements or weights, and complete preparation instructions. By entering your recipe, you agree that the Stations reserve the right to edit, adapt, publish, and use any or all of them, without compensation. There will be fifteen (15) “Entry Periods” during the Promotion Dates as follows.
Entry Periods begin at 7:00pm CT on the first date and end at 11:59pm CT on the second date. The dates for each Entry Period are as follows:
• From 8/24/2012 to 8/30/2012;
• From 8/24/2012 to 9/06/2012;
• From 8/24/2012 to 9/13/2012;
• From 8/24/2012 to 9/20/2012;
• From 8/24/2012 to 9/27/2012;

All online entries must be received during the above deadline dates to be eligible for that Entry Period’s random drawing; all entry submissions will be automatically eligible for all future Entry Period drawings throughout the Promotion Dates. You do not need to resubmit your entry to be eligible for the next Entry Period’s drawing. NOTE: BY ENTERING THE PROMOTION, ENTRANTS CONSENT AND AGREE TO THE STATIONS UNLIMITED USE, EDITING, BROADCAST AND/OR PUBLICATION IN ANY MEDIUM (OR DECISION NOT TO BROADCAST, PUBLISH, AND/OR USE) THE ENTRY RECIPE OR ANY PORTION THEREOF AT THE STATIONS SOLE DISCRETION. BY PARTICIPATING IN THE PROMOTION, ENTRANTS ALSO AGREE TO CERTIFY THAT THE SUBMITTED ENTRIES ARE THE CREATIVE WORK OF THE ENTRANTS.
c. Each recipe must be the original, creative work of the entrants and must not contain any materials that may be restricted, prohibited or outlawed by federal, state or local laws. All entries must be “radio clean.” The Stations, at their sole discretion, reserve the right to disqualify any entry if such submission contains illegal, indecent or otherwise offensive material, or if such entry contains material whose content is deemed, at the sole discretion of the Stations, to be unsuitable for publishing, public performance, or broadcast.
d. There is no limit to how many entries a person is permitted to submit in the Promotion, but a person can only enter the same original recipe only once.
e. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by the Stations. Stations’ computer is the official time keeping device for the Promotion. The Stations are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. All entries must be received by the above deadline dates specified in Section 1(b) to eligible for that Entry Period’s random drawing.
f. Only one (1) winner per household is permitted in any Promotion conducted by the Stations.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all persons who are 21 years of age or older and who reside in Illinois, Indiana or Wisconsin. Employees of the Chicago Bears, the Stations, their licensee, each of their respective parent, Promotion’s Sponsors, subsidiary and affiliated entities, the Stations’ advertising and promotional agencies, its participating sponsors, other radio stations in the Chicago metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
b. Entries must be the original recipe of the entrant.
c. Food professionals (e.g., chefs, food writers, or someone who creates recipes for pay) are ineligible to participate or win.
d. Persons are eligible to win a prize valued over $50 (or tickets valued over $100 per ticket) in a Promotion conducted by the Stations only once every thirty (30) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per household is permitted in any promotion conducted by the Stations.
e. The winner must provide valid government-issued photo identification and sign a prize waiver and release including their complete address, date of birth and phone number to claim a prize.
f. Entrants are required to provide truthful information and the Stations will reject and delete any entry that it discovers to be false or fraudulent. The Stations will disqualify any entry from individuals who do not meet the eligibility requirements. The Stations will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
a. A total of fifteen (15) weekly qualifying prizes (“Finalist Prizes”) will be awarded to a total of fifteen (15) separate finalist prize winners (“Finalists”) during the Promotion. One Finalist will be selected following each Entry Period as described above in Section 1(b) and in Section 4 of these official rules. Each of the fifteen (15) Finalists will receive a Finalist Prize package including: one (1) case (12 bottles) of Mr. & Mrs. T Bloody Mary Mix; three (3) 2.5 pound containers of Papa Charlie’s Italian Beef, one (1) $75 dollar gift certificate redeemable at Joe’s on Weed Street in Chicago (gift certificate is subject to the terms and conditions as set forth by the issuer of the gift certificate); one (1) Jack Daniel’s cookbook, and one (1) case (24 cans) of Pepsi or Pepsi product. Approximate Retail Value (“ARV”) of each weekly Finalist prize is $182.00.
b. In addition, each of the fifteen (15) Finalists will automatically be entered in the Tailgate Throwdown Recipe Contest (the “Event”) scheduled for Sunday, 12/30/2012, at Joe’s on Weed Street. Finalists may also have their recipe featured on http://www.tailgatethrowdown.com, a special event program cookbook and featured in a radio promotional spot during a Chicago Bears radio network Pre-Game show.
c. One (1) Grand Prize will be awarded. Grand Prize is a one-thousand dollar ($1,000) Jewel-Osco gift card and roundtrip coach airfare for the Grand Prize Winner and one (1) guest from Chicago, Illinois to any NFL city in the United States where a game is being played, departing and arriving TBD; one (1) night double occupancy (standard) accommodations at a TBD area hotel, and two (2) tickets, seating location TBD, to an NFL game of the Grand Prize winner’s choice, scheduled TBD during the 2013 football season. Grand Prize does not include meals, entertainment, spending money, parking, food, souvenirs, tax and/or gratuity and any other incidental expenses. Grand Prize ARV: $3,000.00.
Certain travel restrictions may apply. Travel arrangements must be made through the Stations. Prize is subject to availability. If the Grand Prize Winner cannot travel on TBD dates specified, the Grand Prize Winner will be disqualified and the Grand Prize will not be awarded. All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips and ground transportation to/from the airport and/or to/from the hotel, are the responsibility of the Grand Prize Winner. The Grand Prize Winner and guest must travel on the same itinerary and are responsible for obtaining all required travel documents, including, without limitation, passports for international travel. If applicable, the Grand Prize Winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during the Grand Prize Winner’s stay. The Grand Prize Winner and guest must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of Sponsor, the Sponsor’s sole responsibility to the Grand Prize Winner will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize. Sponsor reserves the right to remove or to deny entry to the Grand Prize Winner and/or guest if either engages in a disruptive manner or with intent to annoy, abuse, threaten or harass any other person at the football game. The ticket(s)/gift card(s)/gift certificate(s)/coupon(s) will be subject to the terms and conditions as set forth by the issuer of the ticket(s)/gift card(s)/gift certificate(s)/coupon(s).
d. Total ARV of all prizes is $5,730.00.
e. Prizes are provided “as is” and without any warranty of any kind. Prizes are non-transferable. Winners will be subject to the terms and conditions as set forth by the providers of the certificates/vouchers. No cash redemption or prize substitution allowed. The Stations reserve the right to substitute prizes of equal or greater value if advertised prizes become unavailable. Prizes are subject to availability. All other costs not specifically stated herein, including but not limited to those of, ingredients for recipes, transportation to and from the Event on the Event date, and parking, are the responsibility of the winner. If the Event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Stations, the Stations’ sole responsibility to the winner will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize.
f. Prize winners will be required to complete Affidavits of Eligibility/Releases of Liability, and Prize Acceptance Forms before prize are redeemed. All prizes or prize certificates may be picked up at the office at the address below. The winner will forfeit any prize or prize certificate not claimed within ten (10) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Stations are not responsible for the safe arrival of a prize or prize certificates.
g. There is no substitution, transfer or cash equivalent for prizes, except that the Stations may, at their sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities, parking or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Stations management with respect to the Promotion are final.
b. Within approximately twenty-four (24) hours of the entry deadline, the Stations will conduct random drawings of all entrants to determine the potential Finalists. The random drawings will be conducted on 8/31/2012, 9/07/2012, 9/14/2012, 9/21/2012, 9/28/2012, 10/5/2012, 10/12/2012, 10/19/2012, 10/26/2012, 11/2/2012, 11/9/2012, 11/16/2012, 11/23/2012, 11/30/2012, and on 12/7/2012. One (1) finalist will be selected in each random drawing following each Entry Period. There will be a total of fifteen (15) Finalists selected in this Promotion.
c. Odds of winning depend on the number of eligible entries received up to the time of each drawing. Weekly Finalists will be notified of potential prize award by telephone or email within five (5) days of drawing.
d. At the conclusion of the Promotion, one (1) Grand Prize winner will be selected by a panel of judges during the Event. On Sunday, December 30, 2012, all fifteen (15) weekly finalists must prepare their submitted recipe and bring completed food to Joe’s on Weed Street, located at 940 West Weed Street, Chicago, IL 60642. Finalists may arrive at Joe’s on Weed Street as early as 9:00 a.m. CT and must be ready to sample their food by 11:30 a.m. CT. If food is not ready to be judged at that time, the finalist(s) will be eliminated from the Grand Prize competition. Finalists will be required to certify that their recipes are their original creation and have not been published or publicized and have not won a cooking contest. Final judging will be done by a panel of celebrity judges. Decision of the judges is final in all matters relating to this Promotion. Each recipe will be judged on 1) Taste, 2) Appearance, 3) Creativity and 4) Overall Tailgate Appeal. Each category will be worth a total of twenty-five (25) points with a maximum of one hundred points (100) points per recipe. The recipe with the most points wins the Grand Prize. In the event of a tie, a Grand Prize Winner will be selected by a random drawing.
e. Entrants who are randomly selected to compete at the Event but do not wish to participate will not be eligible to be Finalists and will not win the weekly prize. Entrants do not need to listen or be present to win the weekly Finalist Prize. Finalists must participate in the Event to win the Grand prize.
f. The winner must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of winning or prize will be forfeited and an alternate winner may be selected by a random drawing of all remaining eligible entries. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Stations (or any other CBS Radio station in Stations’ market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Stations, in their sole discretion, may require Promotion winner (and any guest(s)) to sign a liability release, agreeing to release and hold harmless the Stations, their licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.
d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Stations that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Stations reserve the right to cancel, terminate, suspend, or modify the Promotion. If the Promotion is terminated before the original end date, the Stations reserve the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.
e. The Stations, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of the Stations’ website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Stations make a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Stations reserve the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
f. The Stations reserve the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Stations, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Stations reserve the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize.
g. The Stations are not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.
h.
