Suit: Chicago Police Drag Man Out Of Vehicle And Falsely Arrest Him

CHICAGO (STMW) -- A federal lawsuit was filed Tuesday by a man claiming that last January Chicago Police officers broke his car window, dragged him out of the vehicle, and threw him face down onto an Englewood neighborhood street before falsely arresting him.

Kyle Kelly claims that he was dropping of a friend at her home Jan. 16 at the 1200 block of W. 76th St. when an unmarked police car pulled up facing Kelly's 2010 Chevrolet Cobalt and shined a flashlight in his face, according to a lawsuit filed in U.S. District Court.

After Kelly turned his high beam headlights on and off, the officers exited the unmarked car and broke the driver's side window of Kelly's car, dragged him out of the Chevrolet Cobalt, and threw him face down into the street, according to the lawsuit.

The officers searched Kelly and the car, which was then impounded, according to the suit. Kelly spent 18 hours in custody.

He was charged with resisting a peace officer, possession of cannabis, and traffic violations, according to the suit. All charges were dismissed, the suit said.

The seven-count suit claims excessive force, false arrest and illegal seizure. The suit seeks a jury trial, damages, attorneys' fees and court costs.

A spokesperson for the city's legal department was not available for comment.
